In this regard, on September 19, 2019, the Central Administrative Court had ruled to revoke and dismiss the Arbitral award mentioned above. Bt the results of the Court’s judgment, the Arbitral award dated on December 20, 2013 shall have no legally binding the EXAT. However, BEM may file an appeal to the Central Administrative court within 30 days from the date of the Court’s sentence.

สำหรับการยกเว้นค่าธรรมเนียมนั้น เป็นเรื่องนโยบายและเป็นอำนาจของรัฐมนตรีว่าการกระทรวงคมนาคม  จึงขอให้นกแอร์ได้เตรียมรายละเอียดข้อมูลเหตุผลพื้นฐานเพื่อนำเรียนต่อไป ส่วนการสนับสนุนการบริการเติมน้ำมันอากาศยานที่สนามบินเบตง ขณะนี้ กรมท่าอากาศยานได้เจรจากับ ปตท.แล้วโดย ปตท.พร้อมให้การสนับสนุนเต็มที่ ด้านการลดภาษีสรรพสามิตน้ำมัน เพื่อส่งเสริมการท่องเที่ยวนั้น จะมีการหารือกับกรมสรรพสามิตต่อไป

หลังจากนี้ กระทรวงพลังงานจะนำแนวทาง หลักเกณฑ์ เงื่อนไขฯ ที่คณะกรรมการกองทุนฯ มีมติเห็นชอบแล้วเสนอให้เสนอคณะกรรมการนโยบายพลังงานแห่งชาติ (กพช.) ซึ่งมีนายกรัฐมนตรี เป็นประธานซึ่งคาดว่าจะมีการประชุมภายในเดือนพฤศจิกายน 2563 ซึ่งหลังจาก กพช. มีมติเห็นชอบก็จะเข้าสู่กระบวนการจัดสรรเงินกองทุนฯ โดยคาดว่าจะสามารถประกาศยุทธศาสตร์การจัดสรรฯ และประกาศเปิดรับข้อเสนอโครงการได้ประมาณเดือนธันวาคม 2563
